If your customer defaults, you can ‘close’ this amicable collection process on day 27 and start a legal process. You can apply this per case or as a general setting for all collection cases that remain unpaid after the notice of default. The dossier in Payt contains all the elements legally required for dossier compilation. The evidence can easily be submitted to the bailiff via Payt. Janssen & Janssen Bailiffs receive the dossier directly and can start efficiently. The mandatory content of the dossier may vary per situation, but includes, for example, the notice of default letter from your debtor; the statute of limitations on your claim; the period for filing a defence; rebuttal of known defences. Even after the amicable collection process, you benefit from Payt’s software!

After receiving notification that we need to proceed with the case, we prepare advice clearly indicating whether it is worthwhile to go to court or not. If so, we send a prepayment invoice of €100.00 + court fees and the summons is prepared. Because let’s be honest, writing it off? Not without an expert having looked at it.
